Terms and Conditions for Perfume Sales

These Terms and Conditions ("Terms") govern the sale of perfumes ("Products") by [Essperi] ("Seller") through its website hosted on Shopify ("Platform"). By placing an order for Products from Seller, you agree to these Terms. Please read them carefully before placing an order

1.  Product Information

1.1    Accuracy:

Seller makes every effort to ensure that the information about the Products, including descriptions, prices, and availability, is accurate and up-to-date. However, we do not warrant the accuracy or completeness of this information.

1.2    Allergies and Sensitivities:

Customers are advised to review the ingredients list provided for each Product and to perform patch tests before using the Products to avoid potential allergic reactions or sensitivities.

2.  Ordering and Payment

2.1    Order Acceptance:

Your order constitutes an offer to purchase the Products. All orders are subject to acceptance by Seller, which reserves the right to refuse or cancel any order at its discretion, including but not limited to orders that appear to be fraudulent or in violation of these Terms.

2.2    Payment:

Payment for orders must be made through the payment methods accepted by Seller on the Platform. All payments are processed securely, and Seller does not store credit card information.

3.  Shipping and Delivery

3.1    Shipping Policy:

Seller will endeavor to ship orders promptly after payment confirmation. However, shipping times may vary depending on factors such as product availability, destination, and the shipping method chosen. Seller will not be liable for any delays in shipping beyond its reasonable control.

3.2    Delivery:

Delivery of Products will be made to the address specified by the customer in the order. Risk of loss and title for the Products pass to the customer upon delivery to the carrier.

4.  Returns and Refunds

4.1    Return Policy:

We accept returns of unused and unopened Products within 14 days of delivery. To initiate a return, please contact our customer service team at info@essperi.com within the 14-day window for further instructions. Returns are accepted only if:

·         The Product is unused and unopened.

·         The Product is returned in its original condition with all packaging intact.

·         You provide a receipt or proof of purchase.

 

We do not accept returns after the 14-day period has elapsed.

4.2    Damaged or Defective Products:

If you receive a damaged package or notice any spills, you must inform us within 14 days of delivery by contacting our customer service team. Please provide proof of damage (photos) along with your report. We will assess the situation and determine the appropriate course of action, which may include offering a replacement or refund based on our assessment.

4.3    Refunds:

Upon receipt and inspection of the returned Products, Seller will issue a refund for the purchase price, excluding any shipping charges, to the original payment method. Please allow 28 days for the refund to be processed. We do not provide refunds for gift codes, vouchers, or promotional items.

4.4    Non-Refundable Items:

Gift cards, vouchers, and promotional items are non-refundable and cannot be exchanged for cash or other products.

5.  Intellectual Property

5.1    Trademarks:

All trademarks, trade names, logos, and other intellectual property rights associated with the Products are the property of Seller or its licensors. No license or right to use any such intellectual property is granted to customers under these Terms.

6.  Limitation of Liability

6.1    Disclaimer:

In no event shall Seller be liable for any indirect, incidental, special, consequential, or punitive damages arising out of or in connection with the use or inability to use the Products, even if Seller has been advised of the possibility of such damages.

7.  Governing Law and Dispute Resolution

7.1    Governing Law:

These Terms shall be governed by and construed in accordance with the laws of the United Kingdom C Ireland, without regard to its conflicts of law principles.

7.2    Dispute Resolution:

Any dispute arising out of or relating to these Terms shall be resolved through negotiation between the parties. If the dispute cannot be resolved informally, it shall be submitted to binding arbitration in accordance with the rules of [Arbitration Service], and the decision of the arbitrator shall be final and binding.

8.  Miscellaneous

8.1    Severability:

If any provision of these Terms is found to be invalid or unenforceable, the remaining provisions shall remain in full force and effect.

8.2    Changes to Terms:

Seller reserves the right to update or modify these Terms at any time without prior notice. The latest version of the Terms will be posted on the Platform.

By placing an order for Products from Seller, you acknowledge that you have read, understood, and agree to be bound by these Terms.
